This privacy policy (together with our Terms of Use and any other documents referred to in it) sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. 1. Information Collection
1.1 In order to provide a better service to you, we may collect and process the following data about you:
1.1.1 Information that you provide to us by filling in forms on our site www.bestmegawaycredit.com and on Mobile Application BestMegaway SuperApp (hereinafter referred as “our site”), in person or through other forms of communication. This includes information provided at the time of registering to use our site, applying for loan and related services or requesting further services. We may also ask you for information at other times, for example in processing the loan application, extending or renewal of loan application or other services, in connection with a promotion or when you report a problem with our site;
1.1.2 Personal data that we may collect includes but is not limited to:
- Personal identification information – such as your full name, national identification number, email address, phone number, gender, education level, marital status, ethnicity, place of residence, employment status, industry of employment and salary payment method that would allow us to contact you personally and as part of our Customer Identification / EKYC process;
- Financial information and documentation – such as salary of your employment, copies of a proof of your income or net worth;
- Account login information – such as your phone number and password, including the information collected through your Facebook, Google or other social media accounts which have been linked to the account on the Website and Mobile Application;
- National identity documentation – such as a copy of your national identity document, proof of residence such as and not limited to electricity and / or water bill, and/or other information deemed necessary to comply with our legal obligations under applicable law;
- Photos or documents – to make your application process easier, we may collect the documents as abovementioned (but is not limited to) as part of our verification and EKYC process;
- App usage and device information – such as type of operating system, device model, information about how you use or navigate our applications including which pages you view and for how long, and other similar information and / or statistics such as date and time of visit to provide us some insights to improve the user experience;
1.1.3 If you contact us, we may keep a record of that correspondence;
1.1.4 We may also ask you to complete surveys that we use for research purposes, although you do not have to respond to them;
1.1.5 Details of transactions you carry out through our site and of the fulfilment of your request;
1.1.6 Details of your visits to our site and the resources that you access; and
1.1.7 Personal data that may be obtained from credit reporting agency (whose contact details can be provided upon request) or from the public domain through different channels, e.g. a public register, a public search engine, a public directory or any social networks etc. Device information may be collected from your web browsers.
1.2 It is necessary for us to collect and process your personal data. Failure to supply such personal data or consent to this privacy policy may result in Best Megaway Credit being unable to process your applications for loan facilities or related services, open or continue accounts. We only retain personal data for so long as it is necessary. Data may be archived as long as the purpose for which the data was used still exists
2. Uses Made of the Information
2.1 The purposes for which information may be used by us in and outside Malaysia include:
2.1.1 Assessing and assisting Financing Providers in assessing the merits and suitability of applicants for loan facilities and related financial services and/or processing and/or approving their applications, renewals and cancellations;
2.1.2 To notify you about important changes and development to the features of the loan facilities;
2.1.3 Assisting Financing Providers and other financial institutions to conduct credit checks and to collect debts;
2.1.4 To communicate with you, including responding to your enquiries and/or complaints and resolving disputes, and to improve our services to you;
2.1.5 Complying with laws and regulations applicable to us or any of our affiliates in or outside Malaysia;
2.1.6 Complying with the internal policies, procedures, measures or arrangements of Best Megaway Credit for the use of data and information and for prevention or detection of money laundering, terrorist financing or other unlawful activities;
2.1.7 Comparing data of data subjects or other persons for credit checking, data verification or otherwise producing or verifying data, whether or not for the purpose of taking action against the data subjects;
2.1.8 Maintaining a credit history (whether or not there exists any relationship between you and Best Megaway Credit) for present and future reference
2.1.9 Ensuring that content from our site is presented in the most effective manner for you and for your computer;
2.1.10 Providing you with alerts, newsletter, education materials or information that you requested or signed up to;
2.1.11 Allowing you to participate in interactive features of our service, when you choose to do so;
2.1.12 Designing and conducting surveys/questionnaires for client profiling/segmentation, statistical analysis, improving and furthering the provision our products and services;
2.1.13 Legal proceedings, including collecting overdue amounts and seeking professional advices;
2.1.14 Researching, designing and launching services or products including seminars/events/forums;
2.1.15 Carrying out our obligations arising from any contracts that may be entered into between you and us;
2.1.16 Promoting and marketing services and products (please see further details in Clause 2.2 below); or
2.1.17 Purposes directly related or incidental to the above.
2.2 We intend to use your data in direct marketing. In this connection, please note that:
2.2.1 Your name, contact details (including address, contact number, email address), products and services information, transaction pattern and behaviour, background and demographic data held by us from time to time may be used by us in direct marketing;
2.2.2 The following classes of services, products and subjects may be marketed in direct marketing:
- a. Credit / loan facilities and other financial services and products provided by us (or our affiliates) and / or third-party financial institutions, insurers, securities and investment ‘services providers; and
- b. Reward, loyalty or privileges programmes, promotional offers and related services.
2.3 In addition to marketing the above services, products and subjects itself, Best Megaway Credit also intends to provide the data described in paragraph 2.2(a) above to all or any of the persons described in paragraph 2.2(b) above for use by them in marketing those services, products and subjects, and Best Megaway Credit requires your written consent for that purpose
2.4 Best Megaway Credit intends to receive money or other property or benefit in return for providing the data to the other persons in the manner described in paragraph 2.3.
2.5 We may conduct direct marketing via fax, email, direct mail, telephone and other means of communication or send e-newsletters to you. You may choose not to receive promotional materials, by simply telling us (see below for contact details), and we will cease to do so, without charge.
3. Disclosure of Your Information
3.1 We will keep the personal data we hold confidential but may provide information to:
3.1.1 Personnel, agents, advisers, auditors, contractors, Financing Providers, financial institutions, and third-party service providers in connection with our operations or services;
3.1.2 Credit reporting agencies and, in the event of default, debt collection agencies;
3.1.3 Our overseas offices, affiliates, business partners and counterparts (if any);
3.1.4 Persons under a duty of confidentiality to us;
3.1.5 Persons to whom we are required to make disclosure under applicable laws and regulations in or outside Malaysia;
3.1.6 Actual or proposed transferees, participants or sub-participant of our services in or outside Malaysia;
3.1.7 Third party financial institutions, insurers, credit card companies, securities, commodities, investment services providers; and external service providers that we may engage for the purposes set out in paragraph 2.2 above, wherever situated.
4. Mobile Access Permissions and Social Media Details
4.1 Our mobile app may ask permissions to access your mobile phone function and details to help us to provide you with a good experience when you use mobile app and also allows us to improve our site. We may request the following permission from your mobile:
4.1.1 Media / Camera (for Document Upload)

5. Security
5.1 All information you provide to us is stored on our secure servers. Any personal data transferred will be encrypted using SSL technology. Where we have given you (or where you have chosen) a password which enables you to access certain parts of our site, you are responsible for keeping this password confidential. 5.2 Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.
6. Changes to Our Privacy Policy
6.1 Any changes we may make to our privacy policy in the future will be posted on this page. If we amend this privacy policy, the amendment will only apply to personal data collected after we have posted the revised privacy policy.
7. Data Transfers
7.1 We may hold your data on servers in Malaysia and any other territories as we see fit from time to time. We may also transfer your data to our overseas offices or to any people listed at Clause 3.1 above, who may be located in or outside of Malaysia.

8.1 By using our service or mobile application, making a loan application or visiting our website, you consent to us collecting and processing your personal data and other activities in accordance with this privacy policy, and you confirm that all personal data provided by you is accurate and complete, and that none of it is misleading or out of date. You will promptly update us in the event of any change to your personal data.
8.2 Under the Personal Data Protection Act (the “Act”), individuals have the right:
8.2.1 To check whether we hold personal data about you and to access such data;
8.2.2 To require us to correct as soon as reasonably practicable any data relating to you that is inaccurate;
8.2.3 To ascertain our policies and practices in relation to personal data and the kind of personal data held by us;
8.2.4 To object to the use of your personal data for marketing purposes and we shall not use your personal data for marketing purposes after you communicate your objection to us; and
8.2.5 To request to be informed which items of personal data are routinely disclosed to credit reporting agencies or debt collection agencies, and be provided with further information to enable the making of an access and correction request to the relevant credit reference agency or debt collection agency.
8.3 You may exercise your opt-out right by notifying us if you wish to object to the use of your personal data for direct marketing purposes. 9. Governing Law and Jurisdiction
9.1 Nothing in this privacy policy shall limit the rights of the data subject under the Act. This privacy policy shall be governed by the laws of Malaysia. You agree to submit to the exclusive jurisdiction of the courts of Malaysia.
10. Language
10.1 In accordance with Section 7(3) of the Act, this privacy policy is issued in both English and Bahasa Malaysia. In the event of any inconsistencies or discrepancies between the English version and the Bahasa Malaysia version, the English version shall prevail.
11. Account Deletion
11.1 Should you require a full data deletion from our platform, you may email us at [email protected] with the title “Account deletion“. After we have verified your request, we will proceed with the deletion.
